In other words, the fast one, or, drum party yay.If you follow these guys at all you may remember a studio video of Dirk once again proving why he’s one of the cleanest, fastest, and grooviest drummers in the biz. Turns out that that video was for this Pittsburgh song and it was a welcome change to actually hear the music behind the mashing (and the kicks for that matter). I’ve included that video below and if you’re as (pick your adjective) as me you can actually attempt to sync the video with the song.

-ne The eviction of Bethany nuns from their convent in the quiet area of Kazimierz Dolny south of Warsaw is currently taking place. Media reports here have claimed the priest has started a sect in the convent, declaring himself the guru, and has sexually molested former Bethany nuns. Whether this is true or just media sensationalism remains to be seen.So since they have been banished by the church, the militant nuns have locked themselves into the convent, refusing to abide by court requests that they leave the premises voluntarily.

Array-ne I, like many people, recently watched last Sunday’s (June 20th) 60 Minutes interview of former President Bill Clinton by Dan Rather. And after having watched the series of poofy softballs underhanded to Mr. Clinton (though Dan furrowed his brow a few times in order to appear the ever-serious journalist, and lowered his voice in a reverential fashion), I was reminded once again of Clinton’s thirst for the spotlight, his overwhelming reliance on denial and megalomania — oh gosh, did I offend? As the BBC News, UK edition indicated: Mr Clinton reacted after presenter David Dimbleby asked him why he had an affair with Ms Lewinsky when he knew he was under investigation by special prosecutor Kenneth Starr for other matters. Lets look at some reviews of Mr. Clintons new book, “My Life,” from the clearly left-leaning New York Times and then the Associated Press. ” Kakutani typifies the book “as a mirror of Mr. Clintons presidency: lack of discipline leading to squandered opportunities. - 47 individuals and businesses pleaded guilty to crimes with 33 of these occurring during the Clinton administration. Clinton was or had: - The first president to establish a legal defense fund [and actually acquire persons to contribute]; Number of times persons (partial list: I don’t have that much space!) testified in court or before Congress they didn’t know, or didn’t recall something: - Hillary Clinton: 250 - Bill Kennedy: 116 - Jennifer O’Connor: 343 - Patsy Thomasson: 420 And, of course, Bill Clinton claimed he would have the most ethical administration ever. He also said: You all will never get over the fact that Bill Clinton was the greatest president in the last 50 years.

I am proud to be a good friend of Matt’s and I can tell you that he thought the world of Casey. I was able to learn in the first 5 minutes that Casey was an energetic, friendly, intelligent, opinionated and pretty woman that just had a zest for life. I’ll bet there are at least 1,000 other people out there that have only met Casey a couple of times and could say how their lives were affected positively by this Angel. A person’s life can be summed up by how they are remembered, and it is very clear to see Casey Kane’s legacy will live on forever.

-ne APPROVE THIS REZONING - IT’S THE HIGHEST AND BEST LAND USE! In common usage, highest and best land use is nothing more than an individuals’ personal opinion concerning how a parcel of land should be used. However, in real estate law and real property appraisal practice, the concept of highest and best land use is a technical analysis which can be used to determine the best use of land, subject to certain assumptions. HIGHEST AND BEST LAND USE - A DEFINITION The concept of highest and best land use originates from the real estate appraisal field. Appraisers define of highest and best land use as: The use, from among reasonably probable and legal alternative uses, found to be physically possible, appropriately supported, financially feasible, that results in the highest land value. DETERMINING HIGHEST AND BEST LAND USE Highest and Best Land Use, by definition, is much more than a personal opinion. Community-wide highest and best land use decisions are made as part of the land use planning process (especially the physically possible and legally permissible criteria) and subsequently identified and regulated in the zoning ordinance. RULES TO CONSIDER FOR ADJUSTING THE PLAN AND ZONING MAP Developers often use Highest and Best Land Use as a reason to change the plan and rezone a parcel of land to another use. Recognizing the community planning process does not truly consider each of the four parts of the Highest and Best Land Use test, there is good reason to listen to the claim and adjust the community plan and zoning when appropriate. When a claim is based on the four part Highest and Best Land Use test it will provide detailed information concerning the physical development of the parcel, an analysis of why it cannot/should not be developed under the terms of the current plan and zoning ordinance, and why it is necessary to change the plan and ordinance to meet current real estate development investment expectations. Planners and local officials serve their communities best when they listen to all claims that a property should be rezoned because the proposed use it is the highest and best land use of the parcel of land.

THREE COMPONENTS OF ZONING Daily administration of the zoning ordinance functionally falls into three duties: Staff Administration - handing out applications, helping applicants in completing the application, review of applications, conformance decision making, referral of applications matters to the Plan Commission or Zoning Board of Appeals, scheduling of Plan Commission and Zoning Board of Appeals actions, and issuance of documentary paperwork. ❑ Never ❑ Sometimes ❑ Often ❑ Frequently ❑ Very Frequently SCORE ☐ 2. ❑ Never ❑ Sometimes ❑ Often ❑ Frequently ❑ Very Frequently SCORE ☐ 3. ❑ Never ❑ Sometimes ❑ Often ❑ Frequently ❑ Very Frequently SCORE ☐ 4. ❑ 0% ❑ Less than 25% ❑ 25% to 49% ❑ 50% to 75% ❑ More than 75% SCORE ☐ 5. ❑ 0% ❑ Less than 25% ❑ 25% to 49% ❑ 50% to 75% ❑ More than 75% SCORE ☐ 6. ❑ 0% ❑ Less than 25% ❑ 25% to 49% ❑ 50% to 75% ❑ More than 75% SCORE ☐ 7. ❑ 0% ❑ Less than 25% ❑ 25% to 49% ❑ 50% to 75% ❑ More than 75% SCORE ☐ 8. ❑ None ❑ Less than five times ❑ 5 to 10 times ❑ 11 to 25 times ❑ More than 25 times SCORE ☐ TABULATING RESULTS For questions one through three give the following scores for each answer; In our opinion a community should consider updating a zoning ordinance when the total score exceeds 25 points and the following trends have been identified using the results of the test: ∙ when administrative staff needs to seek interpretations of zoning ordinance language “frequently,” ∙ when more than 25% of the applications require rezoning or special land use permission, ∙ when more than 25%of the actions require issuance of a dimensional variance, and ∙ when more than 50% of the applicants require staff assistance to complete an application.

-ne March 31, 2004 RETAIL BUSINESS INCUBATORS A DOWNTOWN REDEVELOPMENT STRATEGY by Charles Eckenstahler, Craig Hullinger and Jim Mooney WHY AN INCUBATOR? Their goal is to fill-up downtown retail buildings with these new businesses and use these new businesses to entice other businesses and revitalize the downtown. Housing these new start-up businesses in our downtown will fill vacant buildings, increase the downtown daytime population and begin to provide a market for more traditional downtown services.” This article summarizes the process undertaken by the Village of Constantine Downtown Development Authority (DDA) as they studied the market for a retail incubator, decided how the incubator should be organized and managed and determined whether it would be financially feasible for the DDA to own and operate the incubator. Small home based business are the most likely tenants in an incubator, The idea of encouraging the starting of new businesses is not a new economic development strategy. In the case of Constantine, research discovered that 1 in 12 Americans was actively trying to establish a new business in 1999 and 10% of males aged 18-64 years and 10% of females aged 25-54 sought to establish a new business in 2000. The market study concluded using the three entrepreneurial profiles that the size of the entrpreneurial market ranged between 18,000 - 30,000 potential new businesses with the greatest confidence being about 26,000 new businesses based on the county profile determined from the county registration data. Beavers noted that “this data confirmed our hunch that if we provided an incubator facility that we could generate enough interest from people living in the area that wanted to start a new business to fill the building with new businesses. Our concern was whether these new start-up businesses would have staying power, add full and part-time employment plus draw customers to our downtown to make a market to revitalize the downtown.” Estimating the staying power of newly formed businesses is most difficult. The data analysis disclosed that there are approximately 670 - 700 operating businesses having less than five employees and that on-the-average slightly more than 100 new businesses register with the county each year. In any single year, the annual growth in the number of new businesses could range between a loss of approximately 30 businesses to a growth of nearly 320 new businesses. To estimate the number of these businesses that would locate in the retail incubator, if developed by the DDA, the question was posed to current businesses owners as part of the survey of businesses registered with the county. The consultant concluded on an annual basis that, of all new businesses started in the county each year between 2 and 29 new businesses would be candidates to locate in the retail incubator. “We recognized the DDA would not have sufficient funds to employ a full time staff person to manage the facility and assist the tenants with their individual business management needs.” To the credit of Beavers, he was able to secure partial financial assistance from the County Economic Development Corporation to provide part-time professional staffing of the facility and technical assistance from several small business service organizations and local university business students. Services brought by others include professional business management assistance, business start-up clinics, business situation case studies, business planning workshops, individual business mentoring and introductions to business financing sources. In other words, according to Beavers, “we needed a selection process that would separate those new businesses that really need assistance to develop successfully from the businesses that might just be seeking cheap rental space.” The DDA settled on six criteria that would be used to evaluate specific businesses, including that the business: 1.

Thanks to a nod from a buddy at boingboing.net, the people are reading. I should make an effort to update this blog more frequently and continue to write about things with a big more social weight than what I had for breakfast (which, for the record, is usually nothing) and the other trivial information I tend to note in my LiveJournal. I will do my best… just keep reading!

In the news today, Ralph Nader has announced his running mate selection for the upcoming presidential election. From the Nader for President 2004 press release:
Peter Camejo (64) is a financier, businessman, political activist, environmentalist, author and one of the founders of the socially responsible investment movement. Camejo is Chair of the Board of Progressive Asset Management of California an investment firm he founded in 1987. Mr. Camejo is a first generation American of Venezuelan decent who was born in New York in 1939. He has fought for social and environmental justice since his teens. He marched in Selma, Alabama with Dr. Martin Luther King, Jr. rallied for migrant farm workers and was active against the war in Vietnam. His most recent run for office was as a Green Party candidate in the gubernatorial recall election in California. His participation in the debates in that election resulted in him speaking to a worldwide audience.

Camejo shares my concerns for economic and social justice as well as the urgent need to protect our environment. He recognizes the disparity of treatment between the rich and poor in the United States as well as the negative impact of corporate control of our government on our environment, health care, working conditions, democracy and culture. Camejo has also been a long-term opponent of the war and occupation in Iraq and the lock-step pro-Israel policy of the United States when it comes to resolving the Palestinian-Israeli issue, noted Nader. His work in advancing socially responsible investment shows his understanding of how we can work within our economic system to advance social justice. Finally, Peter has shown himself to be skilled in political debate and I look forward to seeing him debate Vice President Cheney and Senator’ Kerry’s running mate.

Active in the environmental movement, Mr. Camejo has served as a member of the Board of Directors of EarthShare in the early 1990s – a coalition of over 40 major environmental groups—and on the Council for Responsible Public Investment which he founded. He also helped form the Environmental Justice Fund, to finance and unify environmentalists of color. From 1999 to 2002, served for three years as a county-appointed trustee of the three billion dollar Contra Costa County Employees Retirement Association. In the early 1990s, he was appointed by the Lt. Governor of Hawaii to be an advisor to the Hawaii Capital Stewardship Forum. He is the author of The SRI Advantage- Why Socially Responsible Investing Has Outperformed Financially (2001), Racism Revolution Reaction 1861-1877, (1976) as well as other books.
Allow the conjecture to begin. Did Nader choose a mainstay in the realm of environmental activism in order to draw support from the Green Party? Is this a tactical move, hoping that the Green Party officially call him their candidate so that he can more easily get on ballots? Probably.

Additionally, The Boston Globe reports that anti-American sentiment in Ireland has been mounting throughout the course of the last four years which, coincidentally, happens to be the term of the Bush presidency. Go figure. According to former Dublin bureau chief Kevin Cullen, There were about 10,000 demonstrators when Reagan visited Ireland

Array-ne slightly later in the day…almost forgot, heard a far more rumorish rumor that the barge may be moving VERY soon, like maybe tomorrow. Theory is that will be too small a space (between the north side of the barge and the south side of Pier 66) to allow any large motorized vessels to use it, which would mean that kayaks could be there even if you accept the premise that motorized & non-motorized vessels have to be separated.

-ne I know that something had to be done after Tiger Woods shot 66-65 on Friday and Saturday during that crazy Masters in 1997. I loved the fact that I was watching the MASTERS, not guys sweating and grinding over a four-foot par putt during a tough U.S. Open. It is the only golf tournament that every golf fan knows everything about (quick, what holes are Amen Corner?), Toughening Augusta National hasn’t done anything except eliminate a re-creation of an event like 1986 (the best Masters EVER) and raise the winning score a few shots here and there.

Others are works of a cartoonist whose influence was wider than is represented by a specific work; so these works (Scrooge McDuck, Dark Knight Returns, The Spirit) are merely touchstones representing that cartoonist’s pervasive impact upon the profession and the craft. an underground creation that crossed-over successfully to syndication, proving that unconventional cartooning can survive in the mainstream. an innovative comic strip in both graphic style and narrative technique, the third of Cole’s masterful achievements in the medium. a social protest series of panel cartoons by a passionate master. a role model in the funnies by a role model at the drawingboard, the first nationally recognized syndicated female cartoonist (although not the first syndicated female cartoonist). shows how cartooning can step beyond laughter into philosophical satire. a comic strip with heart and humanity, setting an example for the medium. Magazine cartoons by Tom Henderson (1950s); one of the most popular comic strips in the medium’s history, the strip’s hero was a role model for young Americans. another cartoonist who infiltrated popular culture, giving his name in the dictionary to any mechanical device that seems more complicated in operation than the task it is intended to perform. a place-holder for the cartoonist who designed Esky, the goggle-eyed mascot for Esquire magazine, and who devised the comedy for most of the magazine’s cartoons in the early years. Political cartoons by Rollin Kirby; the first winner of a Pulitzer for editorial cartooning, Kirby invented the notorious Mr. Dry, a funereal symbol of Prohibition in the twenties. established the continuing story mode for daily comic strips, making suspense a vital ingredient on the comics pages. New Yorker cartoons by Charles Addams; established the macabre in cartoon humor. the most widely circulated comic strip in history (about 4,000 base and unit newspapers during World War II), it featured the curvaceous Miss Lace, a daringly risque departure in comic strippery but justified considering the exclusive audience–soldiers and sailors in wartime, who, Caniff said, needed to be reminded of what they were fighting for. the first lady of cartooning (who was doing editorial cartoons for a daily newspaper before women could vote), Edwina defied logic again by producing the epitome of a boy strip for over 40 years. Editorial cartoons by Jeff MacNelly (c. the pace-setter in editorial cartooning for the last quarter of the century. New Yorker cartoons by George Price; Masses cartoons by Art Young; exemplar of an idealistically driven cartoonist, Young never drew a cartoon whose message he didn’t believe in passionately once he’d converted to Socialism in the early years of the century. Editorial cartoons by J.N. perhaps the first nationally-recognized editorial cartoonist, Ding set the graphic fashion for his generation of the breed. a beautifully executed expression of a cartoonist’s belief in his art and in the moral function of heroism. Playboy cartoons by Jack Cole; Editorial cartoons by Paul Conrad; Editorial cartoons by Herblock; Willie and Joe WWII cartoons by Bill Mauldin; Cartoons in True magazine by Virgil Partch (VIP) (c. re-vitalized the single-panel magazine gag cartoon by making the sense of the picture dependent upon understanding the caption beneath and vice versa. apart from the novelty of an elastic superhero, these comic books were hilarious demonstrations of the power of sight gags to infuse a creation with a distinctive ambiance–in short, a cartoonist’s power. New Yorker cartoons by Peter Arno (1927-1950); embodying the spirit of the magazine as no other New Yorker cartoonist, Arno made his words completely dependent upon the pictures for comedic sense (and vice versa) thereby establishing the single-speaker caption for gag cartoons. another who, like Mullin, embodies an entire cartooning genre. Editorial cartoons by Pat Oliphant; revolutionized the appearance of editorial cartooning and its method by making comedy a weapon. at its best, this strip scaled the heights to which the visual-verbal medium of cartooning can aspire by combiningvaudevillian comedy and caricature with satirical allegory, creating meaning on two levels at once, each serving the purposes of the other.

The winding roads traversed gorgeous scenery, but they would have been difficult on the right side of the road. On the left side, they were outright scary. One thing you never think about when driving, because it comes automatically, is how close you are to the curb on the opposite side of the driver. This was a useful technique and highly recommended for all those planning to travel to backwards nations where they drive on the wrong side of the street. The scenery was amazing along the water, and when we finally got around the Coramandal peninsula to see the ocean, it was breathtaking.

It’s long cool nights with shivering hands that I try to find reason for our lives. This world is so painful in so many ways: it’s heartache with love, it’s contempt towards injustice, it’s lies that we find out. It is injustice in the eyes of the poor, greed in the eyes of our leaders, and broken hearts, for the broken mothers who lost their sons in a broken war. Our shaken hands with our shaken souls will find their strength from within community upon community. And with our own found truth, with our descent from injustice toward a land of compassion, we will find a fist raised in the air: one of resistance, a united hand not shaken by these fears, but a fist that shouts fear into those that build their lives on our fears.

Array-ne After moving up three places in the season-ending WTA list last week, Sania Mirza again slipped one rung to 67 in the latest WTA singles rankings announced on Monday. After a miserable year, which saw her start at a career-best 31st ranked, Sania has 382 points. The 19-year-old Indian held on to her 24th spot in the doubles rankings with a total of 1,070 points.Leander Paes, who along with his Czech partner Martin Damm bowed out in the semi-finals of the ATP Masters in Shanghai, is still in 12th place with 3285 points.Mahesh Bhupathi occupies 30th spot with 1,400 points.

From a thorough perusal of the box score, however, several thoughts come to mind:Reynolds played a solid game.Scottie split the point duty with Mike Nardi for much of the game, and turned in a nearly flawless performance. No steals, which is a little disappointing, but otherwise, looks like a very solid game for our highest-touted freshman.Sumpter was explosive (in the first half)Curtis poured in 17 points in only 20 minutes played, mostly in the first half. Curtis also went 3-5 from the three, had 3 steals, and 2 rebounds.Nardi was a workhorseMike Nardi led the team in minutes played with 36 tonight. Solid night from Will.Big bench contributionJay went with an unusually deep rotation tonight: Nine players saw 13 or more minutes. Shane Clark played 28 minutes off the bench, putting in 12 points and grabbing 6 rebounds.

-ne The Union governmnet has decided to set up Special purpose vehicles to restore the National Highway reaches of NJ-34 and NH-66, in West Bengal and Tamil Nadu respectively, affected by heavy rainfall and landslides. In a meeting between Union Minister for Shipping, Road Transport & Highways, T R Baalu and senior officials of Department of Road Transport & Highways and the National Highways Authority of India today, it was decided that the vehicle would be set up in co-ordination with concerned state governments, a press release said. This step would take care of suitable timely remedial measures and ensure that work of emergent repairs could be taken up immediately, the release added.Large scale damages have been reported in both highways due to incessant rains in the past two months. In Tamil Nadu alone, the stretches along the Coimbatore-Mettupalayam-Ooty-Karnataka border on NH 67 extensions and the Tindivanam-Pondicherry stretch of NH 66, were badly damaged due to rains while heavy landslides in Mettupalayam had resulted in diversion of vehicular traffic, the release said.Source: Chennai Online

-ne November 17, 2006SEFCU ArenaAlbany, NYRecord: 2-0Watching Big Board Sports on Thursday night, I saw a report that Jamar may still be suffering from the dehydration issues he experienced during the Bucknell game and may not be 100% for the Delaware game. From that point, the Danes never rally looked back as they went on a 23-12 run to close out the half, extending their lead to 43-32 at the half. Jason Siggers took over in the early stages of the second half of the game, singlehandedly going on a 9-0 run to in the first 2 minutes of the second half to extend Albany’s lead to 50-32. The last 8 minutes of the game were brutal and Delaware actually had a shot to climb back into this game, as they closed Albany’s 18-point lead to 12 with just over 4 minutes to play.

Array-ne Well, I’d dearly love to blog tonight about the interesting changes at work, but I really think it would cause unwanted trouble if anyone found out who I am. I saw their performance at the Grammy’s the other night (taped), and was pretty impressed with the quality of Bono’s voice, which has started declining in the past several years. I’ve heard they may not be able to tour at all this year, due to an illness in a bandmember’s family. If it was me, and I’d made it to the top of my profession like they have, after twenty-five years, I’d be ready to try something else or do a Johnny Carson and disappear for the rest of my life. Ironic that, having just released what they believe is the record they’ve spent twenty-five years trying to make, U2 might be able to tour for it. If the Beatles could go out on top and still be huge forty years later, surely it wouldn’t be a problem for U2.

The cutest thing he did today was crawl up on my back while we were sitting on the floor doing a puzzle, put his face against my cheek and said…hi. haha I almost alphabetized my videos as I was putting them in the box (to later unload) for school and put all my sharpies in rainbow color order in their little ziplock bag…but I held myself back.

Array Rasmussen Reports polling found that 72% of Americans believeit’s Very Important to reduce illegal immigration and enforce the borders.Just 29% said it was Very Important to legalize the status of thoseillegally living in the country today.”Yesterday on Fox News Sunday, White House spokesman Tony Snow said, “Oursense is that if Majority Leader Harry Reid brings it back up, which heshould, and permits a full debate, …we’re not only going to get a bill, butwe’re going to get a better bill.”Really? and–The Coburn-DeMint amendment to guarantee full border security prior toamnesty, defeated 42-to-54.(To see how your senators vote on these amendments, be certain check outCWF’s online Congressional Scorecard at http://www.cwfpac.com)Maybe President Bush is going to go to Capitol Hill tomorrow and urgesenators to reconsider their votes on these important border securityamendments. I suspect Harry Reiddecided to cut off the debate last week because all these votes againstcommonsense border security issues was getting a little embarrassing. As Rasmussen Reports noted, border security could rally the overwhelmingmajority of Americans and unite the conservative base against Ted Kennedyand the pro-amnesty liberals in the Senate.

1. “In the course of the years, Israeli settlements have been established in the Gaza Distric and the areas of Judea and Samaria… The status of these settlements derives from the status of the territory, which is held in ‘belligerent occupation’… When the petitioners settled in Gaza Strip and northern Samaria, they did so in full knowledge that they were settling in territory held by Israel in belligerent occupation…” (Israeli government before Supreme Court, Spring 2005). 2. “My conclusion is that civilian settlement in the administered territories contravenes the explicit provisions of the Fourth Geneva Convention.” (Theodor Meron, the legal counsel of the Israeli Foreign Ministry in 1967). 3. “The preeminent obstacle to peace is Israel’s colonization of Palestine.” (Jimmy Carter, March 2006). 4. “It’s like a meeting with a dietician. We have to make them much thinner, but not enough to die.” (Dov Weissglas/ advisor to the Israeli Premier explaining the logic behind Israel’s refusal to transfer the tax revenues that it collects on behalf of the Palestinian Authority, March 2006). 5. “I do not believe you can have a million starving Palestinian and have peace,” (James Wolfensohn, March 2006). 6. “… an unfettered flow of people and goods between Gaza and West Bank is needed to link the two territorial elements of the Palestinian economy, and to lay the basis for viable statehood. A functioning link would create a larger effective internal market, help trigger price and income convergence between Gaza and the West Bank and provide a pathway for the economy of the West Bank to a future seaport in Gaza.” (The World Bank Group, December 2004). 7. “If I were an Arab leader I would never make terms with Israel. That is natural: we have taken their country… We come from Israel, it’s true, but two thousand years ago, and what is that to them? There has been anti-Semitism, the Nazis, Hitler, Auschwitz, but was that their fault? They only see one thing: we have come here and stolen their country. Why should they accept that?” (David Ben-Gurion, 1956). 8. “The IDF… is turning into a killing machine whose efficiency is awe-inspiring, yet shocking.” (Haartez, March 2003). 9. “This is much worse that apartheid,… The Israeli measures, the brutality, make apartheid look like a picnic. We never had jets attacking our townships. We never had sieges that lasted month after month. We never had tanks destroying houses.” (Ronnie Kasrils describing following his visit to the oPt in 2004). 10.“Committee staff delegations have been unable to understand how currently routed barrier in Jerusalem – which rips asunder the existential poles of Christian belief, Nativity and Resurrection, encloses 200,000 Palestinians on the Jerusalem side of the barrier – will improve the security of Israel’s citizens. The fact that the barrier is to be lines with settlements discloses political goal irreversible in nature, contrary to Israel’s declarations.” (Congress of the United States, Committee on International Relations, Staff Report – May 2006) . 11. “[The] formula for the parameters of a unilateral solution are: To maximize the number of Jews; minimize the number of Palestinians; not to withdraw to the 1967 border and not to divide Jerusalem.” (Ehud Olmert, 5 December 2003) . 12. “The Court is not convinced that the construction of the wall along the route chosen was the only means to safeguard the interests of Israel against the peril which it has invoked as justification for that construction.” (International Court of Justice, July 2004). 13. “You don’t simply bundle people onto trucks and drive them away…I prefer to advocate a positive policy, to create, in effect, a condition that in a positive way will induce people to leave.” (Ariel Sharon, 24 August 1988) . 14. Apparently the I a e public is accepting a situation in which military activity in Palestinian towns is accompanied by indiscriminate killing. (Haaretz editorial writer, 29 January 2004) . 15.

However, Israel has been able to violate Palestinian human rights because there is nouniversally enforced system of international law and because Israel, against world opinion, refuses to recognize the territories asoccupied. Unless the international community demands that Israel respect the rule of law andhuman rights, Israel will arrogate to itself the authority to ethnically cleanse the Palestinians from their land (as it has already beendoing) in any way it chooses. The reasonable personwould know that a just outcome for a violated people illegally dispossessed, illegally discriminated against and illegally occupied isonly possible through universal respect for international law and a universal agreement for a system to enforce it.Disengagement from Gaza but controls remainSince Israel pulled the settlers out of Gaza in what was called “disengagement”, it no longer regards itself as occupying Gaza, andtherefore, not subject to the obligations of an occupying power. These measures have had a devastating effect on the properfunctioning of civilian life inside Gaza thereby violating international law, international human rights law, international humanitarianlaw, and Israeli constitutional and administrative law.Israel’s plan for permanent controlIsrael’s Prime Minister Ehud Olmert’s Convergence or Realignment Plan seeks to impose unilaterally Israeli control over a“sovereign” DEMAND THAT ISRAEL ABIDE BY INTERNATIONAL LAW AND CONVENTIONS AND UN RESOLUTIONS THAT REQUIRE IT TO FULFIL ITS LEGAL OBLIGATIONS AS AN OCCUPYING POWER AND DEMAND AN END TO THE ILLEGAL OCCUPATION.References:Gisha: Legal Center for Freedom of Movement - “Disengaged Occupiers: the Legal Status of Gaza”, January 2007Israel Law Resource Centre, “Is Israel Guilty of Violating International Law?”
